The Truth About Lawyer Advertising

Unless you live in a box, you are bombarded daily with lawyer advertisements.   You have probably seen everything from “we are the most caring law firm” to “we are the most aggressive fighters” to “we are the only law firm that loves families,” and everything in between.  The new craze is to even put a picture of a client on a billboard smiling and holding a settlement check.  There is no end.

The problem with lawyer advertising is that, aside from what the lawyer (or advertising company) chooses to write on a billboard, or what they say in their television commercial (or worse, what their paid spokesman says), you really learn nothing about the law firm when you hire them.   Worse yet, you have not learned anything about the important process and challenges that lay ahead of you.

Are Big Advertising Personal Injury Law Firms Better?

Unfortunately, mass lawyer advertising promotes a culture of settlement.   When huge expenditures are made on advertising, there is more internal pressure to keep the money rolling in.   The easiest way to do this is by settling cases.  Often times this occurs at the expense of the client, where the lawyer accepts the highest offer, regardless of whether it is fair and reasonable.   And since mass advertising brings in a volume of clients, the lawyer can just go on to the next case.  The client, however, is left with no case.

The only way to get the real value of a personal injury claim is from a jury.  With that said, the reality is that many cases do settle before they ever get to trial.  This is largely due to various risk factors that develop during a case that make trial the least attractive means of resolution for the client.  This does not mean that you should simply accept an offer just because it is the “highest” and “final” offer being made by the insurance company.  We have found that the closer trial is, insurance companies have a way of increasing their “final” offer.   However, if the insurance company refuses to be fair, a trial must be an option.  Unfortunately, today there are few lawyers that actually try lawsuits.
